All Day Technologies, Inc., doing business as Pickl ("Pickl," "we," "us," or "our"), respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Pickl platform, including any associated website, browser extension, mobile application, or merchant integration (collectively, the "Services").
By using the Services, you consent to the practices described in this Privacy Policy. If you do not agree, do not use the Services.
1. Information We Collect
1.1 Information You Provide
We collect information you voluntarily provide, including:
- Account information: Name, email address, phone number, and date of birth.
- Identity verification: Legal name, date of birth, state of residence, and government-issued identification documents as required for eligibility and tax compliance.
- Tax documentation: Taxpayer identification number (W-9 or W-8BEN) when required for IRS reporting thresholds.
- Communications: Messages, feedback, and other content you submit through support channels or surveys.
1.2 Information Collected Automatically
When you use the Services, we automatically collect:
- Device and browser data: IP address, browser type, operating system, and device identifiers.
- Usage data: Pages visited, features used, interactions with the Services, and session information.
- Transaction data: Purchase history, Cashback earned, Boost Rewards received, and prediction activity.
- Fraud prevention data: Device identifiers, usage patterns, and behavioral signals used to detect and prevent fraudulent activity.
- Location data: General geographic location derived from IP address.
1.3 Information from Third Parties
We receive information from third parties in connection with the Services:
- Merchant and affiliate partners: Transaction confirmation, purchase amounts, and order status for Cashback and reward verification.
- Authentication providers: Account authentication and verification data.
- Prediction market data providers: Event outcome data used for Campaign settlement.
2. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the Services;
- Process and verify Qualifying Purchases, Cashback, and Boost Rewards;
- Verify your identity and eligibility;
- Settle Campaigns based on verified Event outcomes;
- Detect, prevent, and investigate fraud, abuse, and violations of our Terms of Service;
- Comply with legal obligations, including tax reporting requirements;
- Communicate with you about your account, transactions, and the Services;
- Send promotional communications (with your consent, where required); and
- Analyze usage patterns to improve the Services.
3. How We Share Your Information
We do not sell your personal information.
We may share your information in the following circumstances:
3.1 Service Providers
We share information with third-party infrastructure and service providers who perform services on our behalf, including authentication, data processing, analytics, communications, and payment processing. These providers are contractually obligated to use your information only to perform services for us and in accordance with this Privacy Policy.
3.2 Merchant and Affiliate Partners
We share limited transaction data with merchant and affiliate partners as necessary to verify Qualifying Purchases and process Cashback. This includes order identifiers and transaction status, but does not include your full personal profile.
3.3 Legal Compliance
We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to: (a) comply with applicable law; (b) protect the rights, property, or safety of Pickl, our users, or the public; (c) detect or prevent fraud; or (d) enforce our Terms of Service.
3.4 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any choices you may have regarding your information.
3.5 With Your Consent
We may share your information for other purposes with your explicit consent.
4. Data Security
We implement industry-standard security measures to protect your personal information, including:
- Encryption of data in transit and at rest;
- Secure authentication protocols;
- Access controls limiting data access to authorized personnel;

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security.
5. Data Retention
We retain your information for as long as necessary to:
- Provide the Services and maintain your account;
- Comply with legal obligations, including tax record retention for seven (7) years;
- Resolve disputes and enforce our agreements; and
- Fulfill the purposes described in this Privacy Policy.
Upon account deletion, we will delete or anonymize your personal information within thirty (30) days, except where retention is required by law or necessary for legitimate business purposes (such as tax compliance or fraud prevention).
6. Your Rights and Choices
6.1 Account Information
You may access, update, or correct your account information at any time through the Platform.
6.2 Account Deletion
You may request deletion of your account and personal information by contacting us. Deletion requests are processed within thirty (30) days, subject to legal retention requirements.
6.3 Marketing Communications
You may opt out of promotional communications at any time by following the unsubscribe instructions in those communications or updating your account preferences. Opting out does not affect transactional or service-related communications.
6.4 Browser Extension
You may uninstall the Pickl browser extension at any time through your browser's extension management settings. Uninstalling the extension stops all automatic data collection by the extension.
7. Cookies and Tracking Technologies
We use cookies and similar technologies to:
- Enable core functionality: Authentication, session management, and security.
- Facilitate affiliate tracking: Monitor and verify merchant purchases for Cashback processing.
- Analyze usage: Understand how the Services are used to improve performance and user experience.
You may manage cookie preferences through your browser settings. Disabling cookies may affect the functionality of the Services, including the ability to track Qualifying Purchases and earn Cashback.
8. Children's Privacy
The Services are not intended for individuals under twenty-one (21) years of age. We do not knowingly collect personal information from anyone under twenty-one. If we become aware that we have collected personal information from a person under twenty-one, we will delete that information promptly.
9. International Users
The Services are available only in the United States of America (excluding New York, Florida, and Rhode Island). If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. Your information will be transferred to and processed in the United States.
10. State Privacy Rights
10.1 California (CCPA/CPRA)
If you are a California resident, you have the right to:

- Delete your personal information, subject to legal exceptions;

10.2 Virginia (VCDPA)
If you are a Virginia resident, you have the right to:

- Opt out of processing for targeted advertising, sale of personal data, or profiling — we do not engage in these activities.

- Obtain a portable copy of your personal data; and
- Opt out of processing for targeted advertising, sale of personal data, or profiling — we do not engage in these activities.

We are committed to complying with applicable state privacy laws as they take effect. If you are a resident of a state with consumer privacy legislation, you may exercise your applicable rights by contacting us as described in Section 12.
10.6 Exercising Your Rights
To exercise any of the rights described in this Section, submit a request through your account settings or by contacting us. We will verify your identity before processing your request. We will respond to verified requests within the timeframe required by applicable law (generally thirty (30) to forty-five (45) days). If we deny your request, you may appeal by contacting us.
10.7 Authorized Agents
You may designate an authorized agent to submit requests on your behalf. We may require verification of the agent's authority before processing the request.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be posted on the Platform with an updated effective date. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised Privacy Policy. If you do not agree to the updated Privacy Policy, you must discontinue use of the Services.

This Privacy Policy applies to all Services, Campaigns, and promotional activities offered through the Platform. Each Campaign page shall include a link to this Privacy Policy. This Privacy Policy is incorporated by reference into the Pickl Terms of Service & Official Rules.
